Terms of Service

1. About these terms
These Terms of Service ("Terms") form the agreement between you ("you" or "User") and The Date Post Inc. ("we," "us," "our," or "Service") governing your use of the website at https://thedatepost.com and the related dating service we operate.
By creating an account, listing, asking for a date, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
These Terms incorporate by reference our Community Standards and our Privacy Policy. Violations of either of those documents are violations of these Terms.
2. Eligibility
To use the Service, you must:
- Be at least 18 years of age. The Service is for adults only and has no path to use by anyone under 18.
- Be legally capable of entering into a binding contract under the laws of your country and province / state.
- Not be prohibited from using the Service under any applicable law, including any sanctions or trade-restriction lists.
- Not have been previously banned from the Service. A ban applies to the underlying government-issued ID, not just to the account; you cannot create a new account by changing email, phone, or device.
We reserve the right to refuse service or terminate accounts where eligibility cannot be confirmed.
3. Your account
3.1 One account per person
You may hold one account at a time. Duplicate accounts will be removed; persistent duplication results in a permanent ban.
3.2 Account security
You are responsible for keeping your sign-in credentials confidential and for all activity that occurs through your account. Notify us at support@thedatepost.com immediately if you suspect unauthorised access.
3.3 Verification
Verification is optional — you can list, ask, and browse whether or not you verify. It runs through Stripe Identity (Stripe checks a government photo ID against a live selfie) and carries a one-time $1.50 pass-through fee that covers Stripe's cost; we keep none of it. Verifying adds a ✓ badge to your profile.
4. The Service, in summary
The Date Post is a paid dating service that lets adult users post an "I'm free in your city today" listing for $6.99. Other users in the same city may ask the listing-poster for a date. Access is sold as a $6.99 Day Pass: your first listing or ask opens a pass that lasts 24 hours, during which you can post a listing and ask people out (each person once). The $6.99 is charged once, when the pass opens — not per ask. A pass runs until its 24 hours are up or until you land an accepted date, whichever comes first: an accepted date consumes both parties' passes — the pass has done its job. When an ask is accepted, the platform shares the phone and/or email each of you has added to your profile so you can arrange the time and place yourselves, and then steps back. We strongly recommend meeting in a public place.
Separately from the Day Pass, any user — and businesses without an account — can buy a $6.99 ticker post: a short, reviewed, 24-hour public message shown in a city. See Section 7A.
The Service is an introduction platform. We do not facilitate, broker, or take any responsibility for what happens at the date itself or afterwards. You are responsible for your own conduct on and off the platform.
5. Acceptable use and prohibited conduct
You agree to follow our Community Standards in full. Among other things, you specifically agree not to:
- Use the Service for sex work, escort services, sugar arrangements, or any compensated relationship (Community Standards Section 3).
- Misrepresent your identity, age, photo, or relationship status (Community Standards Sections 1.5, 2.1, 2.2).
- Include phone numbers, email addresses, social handles, addresses, or "come over" invites in your bio (Community Standards Section 4.2).
- Post a photo of anyone other than yourself, including any minor, including your own children (Community Standards Section 4.4).
- Use the Service to harass, threaten, defame, dox, or stalk any other user.
- Post screenshots of other users' bios, listings, or asks publicly (Community Standards Section 4.6).
- Reverse-engineer, decompile, scrape, or systematically extract data from the Service.
- Interfere with the Service's operation, security, or other users' use (denial-of-service attempts, exploit attempts, automated abuse).
- Create or maintain duplicate accounts.
- Evade a prior ban by using a different ID, device, or jurisdiction.
This is not an exhaustive list. The full conduct rules are in the Community Standards.
6. Listings
- A listing runs for 24 hours from the time it is posted.
- Listings expire automatically 24 hours after posting. There is no carry-over, no auto-renewal, and no premium "stay live longer" option.
- You may hold one active listing at a time, in any one city.
- Posting a listing uses your $6.99 Day Pass (or opens one if you don't have an active pass). The pass buys 24 hours of access, not a guaranteed response, and is non-refundable except as described in Section 8.
- Listings are visible to users in the listing's city. They are not posted to any third-party site or shared outside the Service.
7. Asks and accepts
- Browsing is free.
- Asking opens a $6.99 Day Pass if you don't already have one active. The $6.99 is charged when the pass opens (your first ask or listing); for the next 24 hours you can ask anyone (each person once) and post a listing, with no separate per-ask charge. When an ask of yours is accepted — or you accept someone's — both passes are consumed at that moment, and a fresh date requires a fresh pass. Your listing, if you posted one, still runs its full 24 hours.
- You may ask any one person at most once a day. If someone declines your ask, you can't ask that person again for 14 days (the clock restarts if they decline a later ask). We don't bar you from asking anyone automatically or permanently. A member may, at their own choice, block you, which stops further asks from you — but a block isn't permanent: the member can lift it (unblock) at any time if they change their mind. Blocking and unblocking are always the member's decision, not ours.
- Acceptance is treated as a real commitment. See Community Standards Section 7. If you cancel within four hours of the agreed meet time, the other party may report it as a no-show.
7A. Ticker posts
The ticker is a separate paid feature from listings and the Day Pass. A ticker post is a short public message shown in a city's ticker for 24 hours. It is not a dating listing, it does not open or use a Day Pass, and it is purchased on its own.
7A.1 What a ticker post is
A ticker post is a short message (1–200 characters) in one of three kinds — event, classified, or special — shown to people viewing that city. It is tied to a city, not to a dating profile.
7A.2 Price
Each ticker post is $6.99 — the same amount in every currency (CAD for Canadian cities, USD for U.S. cities, the local currency for other markets). The exact amount and currency are shown before you pay. It is a one-time charge for that single post and does not include or open a Day Pass.
7A.3 Review before publishing, and how you are charged
Every ticker post is reviewed before it goes live. Because of that, the $6.99 is placed as a hold (authorization) on your card when you submit, and is only charged if a moderator approves the post. If it is approved, the hold is captured (you are charged $6.99) and the post goes live. If it is rejected, the hold is released, you are not charged, and the rejection includes a brief reason. Card authorizations expire after a few days; if a post is not reviewed before the hold lapses, it will not publish and you will not be charged. Holds and captures are processed by Stripe (see Section 8).
7A.4 Life and expiry
An approved ticker post runs for 24 hours from approval, then expires automatically. There is no carry-over, no renewal, and no option to stay live longer — post again if you want to appear again.
7A.5 Posting as a venue (no account required)
A business or venue can submit a ticker post without creating an account, by providing a venue name and a contact email. The same review, hold-and-capture, content rules, 24-hour life, and $6.99 price apply, and the receipt and any status notice go to the contact email provided. By submitting a venue ticker post, you confirm you are authorized to post on behalf of that venue; submitting in the name of a business you do not represent is prohibited. Accepting a paid venue ticker post is not an endorsement, partnership, or safety-partner relationship between The Date Post and that venue.
7A.6 Content and refunds
Ticker posts must follow the Community Standards — no solicitation or compensated arrangements, no contact information or private-location invites, no content involving minors, and no impersonation. The pre-publish review enforces this; a post that fails is rejected with no charge. Because you are only charged when a post is approved and published, an approved post that simply draws little attention is not refundable — you bought the placement, not a result. Genuine billing errors are corrected as described in Section 8.
8. Payments and refunds
8.1 Payment processor
All payments are processed by Stripe. We do not see or store your card number, CVV, or full bank details. By making a payment you also agree to Stripe's terms. We retain only the Stripe transaction token, amount, and timing.
8.2 Currency
You're charged in the currency of the city your listing or ask is for — Canadian dollars (CAD) for Canadian cities, U.S. dollars (USD) for U.S. cities, and the local currency for other markets as they open. The exact amount and currency are shown before you pay. Your card issuer may apply foreign-currency conversion fees; those fees are not part of the price you see in-app.
8.3 Refund mechanism
A Day Pass buys 24 hours of access — a listing slot plus the ability to ask — not any particular outcome. We do not guarantee that you will receive asks or secure a date, and a pass that has run is not refundable on the basis that it was quiet. Where the law requires a refund, or where something genuinely went wrong on our end, that still applies:
- No asks. A listing that ran its time and received no asks is not refundable. We sell the placement, not the response.
- Early withdrawal. If you pull your listing down before it expires, no refund or credit is owed — you chose to post and chose to remove it.
- Landed a date. A pass consumed by an accepted date has been fulfilled — that is the product working — and no refund or credit is owed for the unused remainder of the 24 hours.
Genuine billing errors — a duplicate charge, or a charge for a listing that never went live — will be corrected. Nothing here limits a refund you are entitled to under applicable law. Where we elect to provide a remedy, we may issue it as a free credit toward a future post or ask rather than cash, except where the law requires otherwise.
8.4 Chargebacks
If you initiate a chargeback through your card issuer for a charge you authorised, your account will be reviewed. Chargebacks for authorised, fulfilled charges may result in account suspension pending resolution.
8.5 Sales tax / GST / VAT
We register for and collect applicable taxes when we are required to. The Date Post Inc. is registered for Canadian GST/HST and collects applicable sales taxes where required. Where GST/HST (or another applicable sales tax) applies to your purchase, it is reflected in the total shown before you pay. The price shown in-app is the amount you will be charged for that purchase. As we open new markets, the applicable tax for each market is shown at checkout. We will notify users in advance of any such change.
9. Verification, moderation, and bans
9.1 We screen bios
Bios are screened pre-publish for solicitation language, contact information, and private-location invites. Failed screens are held or rejected. We do not disclose which specific term tripped a screen because doing so would teach evasion.
9.2 We act on reports
Reports of harassment, solicitation, no-shows, impersonation, or other Community Standards violations are reviewed within four hours during platform-hours. Confirmed safety violations or solicitation result in permanent bans.
9.3 Strikes and bans
- A confirmed violation can result in a strike, which stays on the account for up to 12 months. Three active strikes restrict the account from posting listings or sending asks until the count falls below three.
- Permanent bans are reserved for safety violations, fraud, solicitation, impersonation, photos involving minors, doxxing, and ban evasion.
- Banned users cannot create another account using the same government ID. Attempted ban evasion is itself a permanent violation.
9.4 Appeals
If you believe a moderation decision was wrong, email support@thedatepost.com. A senior moderator reviews appeals.
10. Intellectual property
10.1 Your content
You retain all rights to the content you post — your bio, your photo, your listings.
By posting content to the Service, you grant The Date Post a non-exclusive, worldwide, royalty-free, sub-licensable licence to host, store, display, transmit, and otherwise use that content solely for the purpose of operating the Service (matching you with other users, showing your listing in the city's page, notifying other users of the date details on acceptance, archival back-up, and similar). The licence ends when the underlying content is deleted from your account, except where retention is required by Section 8.5 of the Privacy Policy or equivalent legal obligation.
10.2 Our content
The Service itself — the website, application, branding, design system, and the underlying code — is owned by The Date Post and its licensors. You may not copy, reverse-engineer, or redistribute the Service or any part of it.
10.3 Trademarks
"The Date Post" and the related logo are trademarks of The Date Post Inc. You may not use them without permission, except to factually refer to the Service.
11. Privacy
How we handle your personal information is described in our Privacy Policy. By using the Service, you agree to the practices described there.
12. Third-party services
The Service relies on third-party providers for authentication (Clerk), payment processing (Stripe), database hosting (Supabase), backend hosting (Railway), and DNS/CDN (Cloudflare). Their respective terms and privacy policies apply where their services are involved. We are not responsible for the conduct of any third-party service beyond our reasonable diligence in selecting and contracting with them.
If a third-party service we use experiences an outage, that may cause the Service to be temporarily unavailable. We will work to restore service as quickly as is practicable but make no guarantee of particular uptime.
13. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that: - The Service will be uninterrupted, timely, secure, or error-free - Any specific user is who they say they are beyond what our verification process establishes - Any date, conversation, or relationship facilitated by the Service will lead to any particular outcome - Other users will behave in accordance with these Terms
We make no representation about the safety, character, or behaviour of other users beyond the verification and moderation processes described in these Terms and the Community Standards.
The Service is not a substitute for your own judgement. You are responsible for your own decisions about whom to meet, where, and how.
14. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
The Date Post and its officers, contractors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or in connection with the Service or these Terms, including loss of profits, loss of data, loss of opportunity, or emotional distress, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising out of or in connection with the Service or these Terms is limited to the greater of (a) the total amount you paid to The Date Post in the 12 months preceding the claim, or (b) CAD $100.
The above limitations do not apply to liability that cannot be limited or excluded as a matter of law (e.g., for gross negligence, wilful misconduct, fraud, or non-waivable consumer-protection warranties in your jurisdiction).
15. Indemnification
You agree to indemnify and hold harmless The Date Post and its officers, contractors, and service providers from any claim, demand, or damage (including reasonable attorneys' fees) arising out of:
- Your violation of these Terms or the Community Standards
- Your violation of any law or any third party's rights (including privacy, intellectual property, or contract)
- Content you submit to the Service
- Your interaction with another user, on or off the platform
We reserve the right to assume the exclusive defence of any matter otherwise subject to indemnification, in which case you agree to co-operate with our defence.
16. Governing law and venue
These Terms are governed by the laws of the Province of British Columbia, Canada, and the federal laws of Canada applicable in British Columbia, without regard to conflict-of-laws principles.
Subject to Section 17, the courts of British Columbia (sitting in Vancouver) have exclusive jurisdiction over disputes arising from these Terms.
17. Dispute resolution
17.1 Informal resolution first
Most disputes can be resolved without lawyers. If you have a dispute with us, contact support@thedatepost.com with a clear description of the issue. We commit to working with you in good faith for at least 30 days before either side initiates formal proceedings.
17.2 Small claims
You may always bring a claim in your local small-claims court (or its equivalent), regardless of any other section of this dispute-resolution provision.
17.3 Arbitration (where enforceable)
Where mandatory arbitration is enforceable under your local law and small-claims is not selected, claims are resolved by binding arbitration administered by a recognised arbitral institution (e.g., the British Columbia International Commercial Arbitration Centre / Vancouver International Arbitration Centre) under its rules in force. The seat of arbitration is Vancouver, British Columbia. Each side bears its own costs unless the rules or arbitrator decides otherwise.
17.4 Class action waiver (where enforceable)
Where enforceable, you and we agree that any dispute will be resolved on an individual basis, not as part of a class, collective, or representative proceeding. Where this waiver is unenforceable as to a particular claim, the rest of this Section remains in force.
17.5 Unenforceable provisions
If any of Sections 17.3–17.4 is unenforceable in your jurisdiction, that provision is severed and the remaining provisions apply.
18. Termination
18.1 By you
You may stop using the Service at any time. To delete your account, go to Account → Settings → Delete account. See Privacy Policy Section 9.3 for what happens to your data on deletion.
18.2 By us
We may suspend or terminate your account, with or without notice, if: - You violate these Terms or the Community Standards - We are required to do so by law or legal process - Your account is fraudulent, compromised, or otherwise creates a risk to other users or the Service
We will give reasonable notice where the violation is non-safety and where the law and the situation allow.
18.3 Effect of termination
On termination, your right to use the Service ends immediately. The provisions of these Terms that by their nature should survive termination (including Sections 10.1, 13–17, and 19) survive.
19. Miscellaneous
19.1 Changes to these Terms
We may update these Terms from time to time. The current version is always available at https://thedatepost.com/legal/terms. Material changes — anything that affects your rights or obligations in a substantial way — will be flagged with an in-app notice and require explicit acceptance at next sign-in.
19.2 Entire agreement
These Terms, together with the Community Standards and the Privacy Policy, constitute the entire agreement between you and The Date Post regarding the Service.
19.3 Severability
If any provision of these Terms is held to be unenforceable, that provision is severed and the remaining provisions remain in force.
19.4 No waiver
Our failure to enforce any provision is not a waiver of that provision.
19.5 Assignment
You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of substantially all of our assets, subject to Privacy Policy Section 6.4.

19.7 Force majeure
Neither party is liable for any delay or failure to perform that is caused by an event outside the party's reasonable control (acts of God, war, civil disorder, government action, infrastructure outage at our service providers, etc.).

Section headings are for convenience only and do not affect interpretation.
